SOSH lawyers have answered this multiple times in this thread. Brady's legal team can't file any paperwork with the courts until Goodell formally issues his ruling. The legalese that I read from this thread is that the case is not "ripe" until the arbitration appeal decision has formally completed. That can not happen until slapnuts gets off his ass.

According to this article, content of texts is kept by carriers for a very short period. My general impression has always been that it's very difficult if not impossible to subpoena them.
