the cooperation issue.  He can can accept that the phone thing was "uncooperative" while still claiming innocence of any actual wrongdoing.
 
He's being accused of stealing a car, and also of a parking violation.  The car wasn't stolen and he won't admit to that, but yeah, I guess the car was a little far from the curb...can I get back on the field now?

Chances Goodell stabs himself in the leg and says Brady did it, using it as a reason to extend the suspension to a lifetime ban? 50%.

Who requested that meeting?  I have to imagine its Roger and I think that only compromises his position, just like his idiotic comments yesterday compromised his position with the judge

Ha, I was going to say I expect NFL leaks afterward that Brady had to be physically restrained from assaulting the Commish.

I just saw this report on ESPN, some significant stuff if you ask me:
 

The NFL on Tuesday changed its settlement offer to Tom Brady, saying there will be no settlement unless Brady accepts the findings of the Wells report, sources tell ESPN's Chris Mortensen.
 
The NFL had no comment Wednesday.
 
If Brady had accepted the findings of the Wells report, he would be contradicting his appeal testimony, under oath, in front of NFL commissioner Goodell on June 23.
 
 
 
So they are basically asking him to admit to perjury.  Even if he was lying, they are insane if they think he is going to do that.
 

Goodell and the league's lawyers, meanwhile, on Wednesday morning met with U.S. District Judge Richard Berman for about 15 minutes before the start of a scheduled court hearing in Manhattan.
 
 
 


Who requested this?  Because if it was Berman, then I think thats pretty telling.  Fingers crossed.

I think he needs to convey absolute and total commitment not only to this appeal process, but to investing in the PR and potential legal campaign he is quite capable of launching once Berman is done.   
 
Roughly stated, "Roger, you have lied about me.  You have defamed me.  You have no case here, no evidence, and no defense for what you have done.  You know it, I know it, and regardless of what Judge Berman rules on the technical legal questions before him, by the time I and my wife are done with this case and the media offensive we will bring to bear every person you have ever met will know it, too.  If you want to avoid that I will work with you to minimize the impact of your retreat on you.  But if you do not, let me be very clear with you, I will take you down and I will not stop.  You have already taken from me what is most important; you need to decide whether you are going to force me to return the favor or not"
 
There are many discussions where one needs to convey that you understand the interests of both sides and are option to creative options to resolve a dispute.  This particular conversation, I believe, is likely the opposite of those.

I'm curious about the pulse of those here as to what will happen if this thing does not settle.  And I don't think it will settle for the reasons that have already been well and often expressed by many on SoSH.
 
I recognize that views could change as more briefs get filed and the process ensues.
 
This thread and poll are meant only to be about what happens in front of Berman. 
 
While people are of course free to discuss whatever they like, I am not asking about what happens on appeal or even if the parties will appeal.  For now, I would rather save that discussion for another day/thread.

There is absolutely zero reason sophisticated parties would ever construe 'there is risk to both sides' to mean 'we should settle in exactly the middle'

Literally, no basis.

Here it means "You each could lose, so think real hard about settling." Honestly, he can't really say anything else at this point.

Saying there are strengths and weaknesses on both sides is typical when trying to push the sides to settle.
 
In other words, it means very little since we already knew that Berman wants a deal.

Well those two quotes from Berman can only be construed as fantastic for Brady. It appears he's not just taking the investigation itself into account, but whether anything actually occurred.
