I think refs have some discretion whether contact was sufficient or a player has gone down too easily. But by and large, fouls in the box are fouls in the box. They are always penalties, whether or not it deprives a scoring chance. Heck, you see attackers with their back to the goal on the edge of the box get fouled and it's a penalty. The attacker played direct and did not initiate contact and he was fouled in the box.
