It's a weird case because there's a complex PR aspect to it but the safest bet is to say nothing in public and let the papers stand for themselves (perhaps with a carefully drafted press release issued when they're sent).

If this is all true, it changes my opinion on the entire matter. Not the part about how ridiculous the entire thing is, but Brady's involvement. Switching out the phone on the day of the Wells Report interview goes beyond suspicion for me. What I don't understand is why Brady and his counsel would acknowledge it at all. Doesn't seem brilliant.

1b) Especially a celebrity
1c) With possible nude pictures of his super famous hot wife
 
2) Brady is not a cartoon supervillan and can delete texts off his phone without sending it to Mt Doom
 
3) There's still no evidence that any illegal ball deflation took place at all. This should really be all that matters. For real.
 
4) Everything else that's been taken out of context and reported by the NFL so far has had a completely mundane explanation ("deflator" being the only tough to swallow explanation, but still acceptable after looking into it). Why would this be any different?
 
This comes off to me like a last desperate attempt to screw Brady over in the public eye. And it's pretty sick. If THIS is the tipping point for any of you, this is not much further from assuming Brady's guilt because someone said "deflator" once.

Felger and Mazz have alluded to this and they have been hammering that the NFL wanted the phone to see who else Brady was texting about deflating the balls, possibly Belichick.  When Felger and Mazz were pressed about why they kept going to this Felger said something along the lines "Hopefully one day we can go into where this info came from but that's what we are being told".  I personally can't recall if they said they got the info from inside the Patriot's organization or someone close to it.

If I recall correctly, that bet isn't final until whatever happens in court is final.

It's not the fact that he regularly does it, which is smart, it's the timing. The exact day he was interviewed by Wells, who made Brady aware he wanted some of his texts? Brady is a smart guy, he'd have to know how this was going to look, and he did it anyway.

What's really interesting is that the NFL's chosen leak and pull quote have absolutely nothing to do with whether Brady knew about any deflated footballs. They're going to stand and fight on the cooperation.

Yes, except for the very same act in the very same invetigation, in which no punishment was handed out. Brady's phone destruction in that regard is irrelevant. The phone was either handed over or it wasn't.

To me, this whole thing has always been about the cooperation.  The Union absolutely doesn't want a precedent set where the NFL can demand private info from its players in an investigation.  The NFL obviously would love the precedent.  I'm surprised they want to bring that issue to court, it seems like a loser to me, but I'm not surprised they're having a hard time coming to an agreement.
 
FWIW, I don't blame Brady one iota for not wanting to turn over his phone or even begin to produce information for the NFL.  I think it's a massive overreach.  But actions do have consequences and unless a court agrees then I suppose you have to be OK with the punishment as well if you don't think he should be giving up that information.  But i just don't believe at all in the "if you have nothing to hide why not give up the info?" train of thought.

Are all links to the ESPN Sports Science about the affects of deflated balls scrubbed from the internet?  If I remember correctly that video was also using the information from the erroneous Mortenson Tweet that the balls were 2 full PSI under.  
 
If anyone didn't see it, they very clearly and emphatically stated that no competitive advantage is derived whatsoever.

Except this would be analogous to a case where a player has an elevated testosterone level, but one still within achievable levels absent PEDs.

There may be valid reasons for destroying that phone (and not the one whose use ended in November) but a Judge is unlikely to fault Goodell for choosing one possible interpretation  -- he was hiding something with respect to the post AFCCG conversations with the ball-men -- over another.  Ultimately someone has to make that decision. In my view, that he was trying to hide some evidence that could lead to a conclusion that he was involved is not an irrational finding.
 
Back to first principles -- the penalty does not fit the crime.

The leaking of the phone destruction is the definition of a red herring. They had no right to Brady's phone before, and still do not have a right to view it.  It is purely public relations posturing.
 
Personally, I am glad they held the suspension at 4 games because now Brady can take them to court. For a couple weeks there, I was worried Brady would settle at ~1 game or so just to put it behind him.

Brady is still missing 0 games, the Jets are still a joke, and we have still seen more titles and playoff games for our team than you will see it you live to be 120. We will be OK.

This does highlight how incredibly inept Goodell is at his job.
 
The number one story for the 2015 season--and maybe the number one issue people will think about down the road when they talk about the league from NFL 2001-2014--is whether the Pats are cheating cheaters who cheated their way to a bunch of superbowls.
 
Now they may or may not be cheating cheaters but why on earth you'd do this to a star player on a star team who is going to be a senator or something some day is just beyond my comprehension, even if he's 100% guilty.

Since leak-and-pull is about PR, its seems pretty clear that "he wrecked the phone shortly before the hearing" is the best thing they've got.

I think its very arguable that the CBA's requirement of cooperation in an investigation *could* mean turning over the phone where they already know he communicated with the ball-people many times. Under that circumstance, it seemed less than a total fishing expedition to me.  I perfectly understand why neither Brady nor the PA wants to interpret "cooperate" that way. And why Brady has a lot to fear about what's on his phone going public from things other than deflated balls. But as long as the request is somewhat narrowly tailored (by time period and recipient, for example) I think its an argument the PA will lose.

I will say this. The phone issue could have been handled better. It almost certainly would have been handled better by Kessler. Too bad Tom did not bring him in earlier and relied on Yee instead

I'm not speculating anything at all. You're missing the point. The overall point is maybe there is an unrelated reason as to why Brady wouldn't turn his phone over. I know that even if my girlfriend looks at one text thread she's going to go through another thread or two. Prrotecting his privacy in this TMZ world is everything. If something damaging was stumbled on he stands to lose a lot more than this case.
