If you're going to not call someone down to let the play go forward (which I'm Ok with) then replay officials have to be willing to rule him down later if that's what the video indicates. And if you open the door to unreviewable calls, you can't be willfully ignorant of other blatently obvious infractions that were not called at the time.
Procedures for reviewing plays exist for a reason. When you change those procedures in isolation to try to deliver a "just" outcome, you are running a rigged game.
