Every penalty can be reviewed. I'm assuming they mean that the ref shouldn't reverse it because there was contact, that it would have to be a 100% verified dive to overturn it. The way I've always interpreted the rule is that if your foot is up above your waist, you're responsible for all the consequences of the result, regardless of intent.
