A defamation suit is still extremely unlikely because 1) I imagine Brady wants this to be over after the second circuit appeal and 2) the standard remains high for a celebrity. But I found this interesting while reading a cNet article about Bose.

On picking Russell Wilson over Brady for ad campaign

So here we have an executive from a Fortune 500 saying they didn't give Brady a potential endorsement deal because of Defelategate. That could help Brady in proving damages.

The NFL got just what they wanted tonight. Manning gets another ring and is gonna retire so that PED thing just disappears, and their vendetta against Brady and the Pats got proven effective with the reception Brady got at the SB tonight.

Hey, did you know that the Broncos have NEVER lost a game reffed by either the guy who did the AFCCG or the guy who did the SB? Crazy, huh? Just a wacky coincidence, I'm sure.

This fucking league is rigged.

I don't believe in the big conspiracy either but that play right before the strip sack TD was a catch.
YES. The ball never hit the ground. Completely obvious on replay. Blandino reserved the right to call in with his judgment on replays too.

That was a catch, and if ruled correctly the next play never happens and the game veers off in a completely different direction. Fucking bullshit.

It's very challenging to prove actual damages in a defamation suit. This is the closest I've seen a corporate executive name Brady specifically as someone that wasn't selected for an ad campaign because of his favorability ratings. It's not a far stretch to get from there to an exec providing testimony that the negative inferences from Deflategate caused them to remove Brady from their short list of ad pitchman.

Sure, but you're employing about 30 different large leaps of logic to get to that assertion. Plenty of people despised Brady before Deflategate for a variety of reasons.

Which is why I specifically said i would want testimony from an exec indicating his/her decision was based on the negative perception of Brady as a result of Deflategate. Based on the context for the Bose exec's quote, it's not a giant leap to think he might provide that type of testimony.

Williams probably isn't aware that Maroney outrushed him in their first two years in the league together. Maroney got injured in his 3rd year (only played 3 games) and was never, ever the same again. Williams' 3rd year is when his numbers took off.

So....whatevs.

Apologies for not being able to find the specific posts, but with the hearing 11 days away, shouldn't we be in the "red zone" in terms of knowing who (viz. identification of judges) will hear the appeal?

Thursday at noon eastern you'll learn the names of three judges, which in all likelihood will tell you nothing of value.

I like this part best

The NFL needed to find out what weather and precipitation and humidity and hot air and frigid air did to footballs, to see if the league’s questionable science in the Wells Report stood the test of an NFL season.
Actually the NFL didn't really need to do this. Science already tells us what all those things do to the air in a football. But if it would make Petey feel better, then sure, the NFL, who has denied science when it comes to the well being of their players, should prove the already proven.

Although King does make a very good point in taking Walt Anderson to task. I have to give him kudos there.

Yeah we were all making that point on Anderson last May but nice to see a national writer get there. Wish PK had also added - how did it happen AGAIN at the start of the second half when security video showed JM leaving the locker room by himself with the ball bag??

I think this section was particularly strong:

A couple of points here: The exact measurements of the footballs before the game were never written down. And there’s no indication that the measurement of footballs before games has been an exact science. I witnessed one such measurement in 2013, before the Baltimore-Chicago game, and official Wayne Mackie at one point stuck a needle in a football that was supposed to be at 12.5 psi. He measured and said, “Twelve and a half, close enough.” What does that mean? Was it 12.36, or 12.62, or something other than exactly 12.50? Regardless, no judge anywhere would bring the hammer down on a situation like this—inexact measurement before the game, an allowance of the footballs to be 11.32 psi, and the balls found at 11.30, on average.

Shoot, for a moment your comment made me think King HAD mentioned the activity before the 2nd half. What a missed opportunity there by King.

He also fails to bring up the combination of factors that may have added to the confusion of what happened to the game balls. Namely that (1) the NFL shuffled the referee crews so that the crews that worked together through out the regular season didn't work together for the playoffs, (2) one of the officials was actually stealing game balls to sell online and (3) that the start of the Pats/Colts game was delayed due to the earlier Seahawks/Packers game going into overtime.

None of that applies to the start of the 2nd half. The evidence is that Walt handled the pregame check as he always did, very casually as was common practice in the NFL. Then when it blew up into a big issue, Walt went into CYA mode and suddenly noted how unusual the bag of balls getting out of his sight was.

(4) If the Wells Context Report is to be believed, plenty of people saw Tweedle Dee take the footballs/carry them around and no one tried to stop him or said anything about it at the time. So how egregious of a protocol break was this anyhow?

No, but it certainly applies to what happened with the balls before the game. From the quote I included, Walt Anderson was distracted and angry over what happened with the game balls before the game but there are a number of factors in that specific situation that had nothing to do with the Patriots or their employees.

I wish he had pointed out Wells taking the exact measurements of the PSI as gospel, but choosing to not trust his memory on which gauge he used. That always struck me as one of the most egregious manipulations of story in the report.

Without rehashing everything, this is step #1 in the Patriots potentially getting the draft picks back. I think it is a long-shot at best, but this is what they need to mount a campaign to do so. They need national writers to make a stink about the draft picks, they need the appeal to be upheld, and they then need to mount a PR campaign in the weeks leading up to the draft leading with 1.) Science, 2.) The Court Case, 3.) Lack of PSI Testing. Kraft will have to call Goodell out on the carpet, and he'll ultimately need to get some other owners to pressure Goodell.

With that said, I think it is a big long-shot -- but, that is the outline that they would need to follow IMO.
