I didn't have time to reply earlier but this was my thinking as well. I feel like if Player Safety seems to only be selectively pointing at some hits and not others it sends mixed messages. If they are up front about Orpik's hit, whether for, against, or borderline, then its as simple as saying "regardless of the prior hit, two wrongs don't make a right and Thornton was absolutely in the wrong in his actions here and we give him x number of games". That would certainly send a message towards retaliatory hits and missed a chance to do so, opting to sweep Orpik's hit under the rug and turn a blind eye.

I don't think that requires a tinfoil hat. I think there's a less nefarious explanation in play as well, though. Orpik's already missing whatever games he would have been suspended for. I think that probably played a role.

Only issue with considering the time lost to injury as a de facto suspension is that Oprik receives no financial penalty, and perhaps more importantly is not considered a repeat offender if something happens again.

For what it's worth, I don't think they would have suspended him anyway.

In regards to Thornton, I imagine the Bruins will be aiding his appeal by putting together a video of similar incidents that resulted in no supplemental discipline. They won't have to look to hard to find many incidents that are equal to it exceed what Thornton did.

Sounds like Thornton will appeal. Not confirmed yet but word is starting to trickle out from the writers on twitter.

Edit: so the process is that Bettman is next, which is really a waste of time since he won't undermine Shanny. Then comes the independent arbitor which is where things will get interesting. Nobody has gotten that far, Kaleta stopped after Bettman

It may be his intent to drag it out as long as possible if he thinks the independent arbitrator will cut it back.

Bettman has upheld the suspension. Thornton now has 7 days to decide if he wants to appeal to an independent arbitor.

At this point, if he pursues the independent arbitor, the only thing he's fighting for is money. He has missed 8 games already. Seems unlikely that he gets another hearing done before his 15 games are up, given he may take a few days to decide if he's going to appeal, and then they have to schedule around New Year's when the league will be preoccupied with the Winter Classic.

I'm stuck at work today, so I read Gary's ruling. Seems like the Union has a very weak case, so I doubt Thornton would win any further appeals. It actually sounds worse, given Thornton's testimony. Amazingly enough, Thornton testified that he was fully in control of his emotions and he knew what he was doing. Originally, at the first hearing with Shannahan, he testified that when approaching the scrum he was simply looking for the biggest Pittaburgh player involved. At the Bettman hearing he changes his story and conceded that he had identified Orpik before reaching the blue line. So the Union's only real grounds for a reduced sentence was Thornton's clean history, which Bettman acknowledges and cites as a reason Thornton "only" got 15. Apparently, when Bettman asked the union reps what they felt an appropriate suspension should be, they didn't have an answer ready. They came up with 10-12 games later on in the hearing.

I just watched Dafoomie's 8 minute Youtube clip on this game's events and I'm furious all over again. One thing stood out that I don't recall people talking about. Orpik is in a post Marchand sucker-knee scrum and getting all brave, buffered by linesmen, with a lesser pugilist. I think it's Campbell. I'm sorry that's just odious on Orpik's part. It's also odious that no call was made on the shoulder to head hit of a player in a vulnerable position without possession of the puck. This is the new NHL and it sucks. Orpik, sans honor, feels no shame in answering Thornton's provocation and would rather look like a complete chickenshit in front of 17,000 away fans than take a small dose of medicine. This breaks down to old guard versus new guard, and until Thornton joined the ranks of those forever referred to as thugs—he represented the old guard. Anyone who thinks fighting has no place in the NHL needs to watch Dafoomie's clip. And they need to reconcile themselves to the shortened careers of the Loui Erikssons of the world. Billy Jaffe called it when he said "this is the game now." I feel like with that incident—the lack of response from referees, Thornton's frustration warping his character, Orpik as a martyr, Neal getting only 5 games—that we are bearing witness to the slow disappearance of honor from the game. I know this pot has simmered, boiled, simmered and cooled. I don't want to bait Greg29 or anyone else—that's not my point at all, I felt a need to vent and cry foul one last time. With that, I'm pouring a Laphroaig, putting the presents under the tree and trying to put my outrage to temporary rest.

Meh, we're getting too worked up on it. I'm sure there are things the refs, Orpik and Thornton all wanted to do differently to varying degrees given the outcome of the events (ie Thornton becoming a complete idiot). That said, I still don't see the POV of the refs being at great fault for not calling a check that was extremely borderline into being an interference. I rue the day for pre-cog refs. Rue I say!
