The #NFL has been ordered to pay 96 million in commercial class damages & 4 BILLION in residential class damages per today's guilty verdict in the Sunday Ticket antitrust trial. By federal antitrust law, that 4 billion becomes 12 billion in actuality. The plantiffs were seeking $21B+. There will almost certainly be appeals here.
The dollar amounts will drive a lot of headlines, but the real news here is that fans should soon be able to purchase single-team streaming packages, while also (hopefully) being alleviated of blackout restrictions at some point as well. This should also set the tone for other major sport streaming packages.

Fantastic! Being able to stream every game in FL during Nov and Dec would be awesome! No more being forced Jets and Fins (and sometimes Giants and Eagles)

Apparently an astrophysicist jurist opened up R to calculate his own damages formula. You cannot possibly imagine how happy I am reading that.

Do they get to clawback Goodel’s bonuses for those “boon” years?

Now do baseball and the ridiculous blackout policies for MLB. So antiquated yet frustrating. I live 4,000 miles away and suffer the blackout of all California teams. Not the Mariners, mind you, just the Cali teams.

Living in CT it would be nice if we could get rid of blackout restrictions for good.

This part sounds great:
Let's wait until John Roberts, et al weigh in before we get too excited.

Do we get full refunds for the years we paid for Sunday Ticket?
It will likely be more along the lines of $12.37 for each season you subscribed after the appeals and the rentiers get their cut. For the most part, the money will be redirected, not returned.

I'm sure I'll regret asking this but, why only Nov and Dec?

This happened under Goodell's watch while he was focused on anti-Patriots witch hunts?

The important question is how will this impact the salary cap in future years. Owners aren't going to pay the freight alone.

It seems like the NFL is going to appeal. I can’t imagine this story is anywhere close to done. Selfishly, I hope it still gives them a kick in the ass regarding the blackouts and product.

The interesting question is whether the court will enter injunctive relief based on the jury’s findings (or already has). Class members are a long way from seeing damages, but injunctive relief — like lifting the blocking of games other than through Sunday Ticket — would be relatively hard to get stayed pending appeal.

This is different from most class action recoveries. Cases almost always settle. This is the very rare class action that went to trial.

The downside of that for the plaintiffs is that the NFL can appeal, whereas a settlement really cannot be appealed (though can be delayed by "objectors"). Once the settlement amounts get significant, class actions often settle because the attorneys fee component is massive. But after a jury trial, there will be more significant damages per class member if the case is ultimately upheld. The judgment will also accumulate interest during the appeal.

It still could settle. In fact, if I were betting, that would be my bet unless the NFL believes that it has a rock solid argument. The number if it settles will be big.

In the Ninth Circuit, the presumptive percentage for class counsel is 25 percent, but that's just a guideline and it depend on factors like how much work was done and how much risk the attorneys took. Since this case actually had to be tried, I would think a bigger percentage likely could get approved by the court. The court will hold a fairness hearing to determine fees.

NFL Finds Judge Open To Tossing $4.7B Sunday Ticket Award

By Craig Clough

A California federal judge appeared open Wednesday to the NFL's argument that he should throw out a jury's stunning $4.7 billion antitrust verdict over the league's Sunday Ticket television package, saying he has "trouble" with the jury's damages award and suggesting that jurors may have disregarded his instructions.

That judge is going to get season tickets for every team, plus 4 Super Bowl tix forever.

As a non-lawyer, this is very confusing to me. If this is the judge's position, why is he only excluding the testimony after the fact? I'm sure with the NFL involved, there is a good opportunity for shenanigans, but hopefully stuff isn't quite that transparent...

U.S. District Judge Philip Gutierrez ruled Thursday that the testimony of two witnesses for the subscribers had flawed methodologies and should have been excluded.

"Without the testimonies of Dr. [Daniel] Rascher and Dr. [John] Zona, no reasonable jury could have found class-wide injury or damages," Gutierrez wrote at the end of his 16-page ruling.

I buy it. All of it. I mean, the NFL league office has always seemed like a stand-up, straight-ahead organization. Nothin' to see here.

It’s a motion to set aside the verdict. I haven’t seen any of the motion papers, but that must have been the NFL’s argument, or one of their arguments, in their post-trial motion.

Yeah. Judge got paid off I’m sure.

Is appeal an option here? Really want the NFL to take it in the shorts.

Don't worry, guys. Media companies and the NFL will figure out a way to get through this...by passing the cost onto the consumers!

Sunday Ticket is available on Apple for a paltry $680! And if you think that's too good to be true, you could even package it with Redzone for a measly $740!

I mean, where are you going to find a better deal that that?!
Shows how popular the NFL is that they can get this price when other streaming services are far cheaper.

That's crazy. I think my YouTube was less than $300 (included early renewal). I don't know why anyone with Apple TV would pay that instead of just getting through YouTube.
