Our days of posting our favorite baseball highlights on Twitter might be coming to an end, if they haven’t already. Recently, it appears as if MLB Advanced Media has been requesting that Twitter remove GIFs (technically, GIFs uploaded to Twitter are converted into video files, but the idea remains) that they believe violate copyright laws. It’s a move that’s both within the rights of MLBAM, yet still slightly confusing from a fan-engagement standpoint. If this is a harbinger of things to come, then our days sharing sports GIFs with our friends and followers might soon be over.
I first heard of the new policy via FanGraphs writer Jeff Sullivan. He had created a GIF of Felix Hernandez and tweeted it, but later got an email alerting him that it had been taken down.
As it happens, MLB had a video of the same highlight on their site. Now, Jeff’s GIF would be in violation of copyright whether MLB had their own highlight posted or not, it just seems like more than a coincidence. In the full email the above picture is referencing, there were other reported tweets from different Twitter users — notably @cjzero, who posts many videos of various sports through the social media platform. Sullivan believes this to be a mistake.
“Weirdly, in the same email, I saw notice of identical complaints filed about @cjzero and @megrowler. I probably wasn’t supposed to see those but multiple people responsible for this are stupid,” he said.
However, it shows that he is not the only one being targeted in this new development.
The idea is simple. MLB sees a GIF of a play or highlight and notices that they have the same video hosted on their web site. However, when the video is viewed on their web site, an ad is played beforehand. On Twitter, it’s not. MLB loses a (probably very tiny) source of revenue. MLB asks Twitter to take it down, Twitter complies.

You would think that MLB would copy the NBA's stance on this and allow fans to create GIF's and VInes of plays. It would also help MLB's effort to appeal to the "younger crowd" that MLB is struggling to get.....

It shouldn't matter what the MLB thinks.  Because they're using them to illustrate their commentary on the games, FanGraph's use of GIFs are fair use in the vast majority of cases.  MLB should be encouraging this kind of use.

Yeah, very surprising the MLBAM can be at the bleeding edge on technology, but stone aged conservative on copyright enforcement.

I know this is often said, but why is my MLB.tv feed always so choppy? I have no issues with any streaming service other than MLB.tv.

They've taken on the WWE channel within the last year. I don't think they have enough bandwidth for what they're doing. Next year, they're taking over the NHL.
 
I know it's them and not my internet, because it's the big games that have trouble (Yankees/Jays), when there's a rally (MLB alerts fans to switch over when something is going one) or when something historic is going on (ARod's 3000th hit, No Hitters etc). Otherwise, my games play fine.
 
I'm getting upgraded to 300/20 by the end of the year, I'm going to see if that clears it up next season. But it's frustrating that it cuts out when there's a big moment going on.

First, this should be fair use.
Second, the DMCA "safe harbor" provision should have a way to claim fair use without requiring immediate takedown.
Third, with the amount of public money subsidizing sports stadiums, short game highlights should be royalty-free to air for both media and individuals.

I've decided to go back to Extra Innings next year for this exact reason, even though it is something like $60 more expensive.  I was considering cutting the cable with DirecTV, but my experience with MLB.tv has made me decide to keep them specifically for EI and the Center Ice package (I can't imagine trying to watch hockey with the type of feed I have had with MLB.tv this year).

It's definitely not a provider problem on my end either. We don't have the fastest connection, but everything else streams fine at home. Our network at work runs at 200 and it's still choppy.

Unloading both barrels. One for each foot. What kind of media dinosaurs are making these decisions at MLB?
 
They are even so far behind the times that they are late to the party of suspending/cutting off external parties that give them free exposure and marketing.
Old media types were on that bandwagon 10 years ago and most of them finally figured out that its a dumb idea.

Per NYT, it was the NFL and UFC going after Deadspin, while SEC and Big12 went after SBNation.  No mention of MLB involvement.
 
Interesting wrinkle in that article: it's the use of GIFs during a game that seems to be the big complaint.

Well, MLB's policy on the use of highlights is ridiculous. Unlike the NBA or the NFL or the NHL, they are aggressive about keeping fans (and writers) from using clips. Among the big sports in the world, they are easily the most backward on the fair use of clips. 
 
As for the NFL - how typically dumb. By going after Deadspin (I wonder how UFC got involved?), and presumably losing - at least in the Deadspin/hardcord football fan demo - Roger has guaranteed that the next person they "bust" will run straight to Deadspin/Keith Olbermann/etc. and there will be an organized response and more bad PR in their base. 

Like not allowing DeAngelo Williams to honor his dead mother with a pink article of equipment all season, this is quintessential NFL.

UFC might have more heavy-handed branding than NFL. No union, and, unique in solo sports leagues, they recently started forcing their fighters to wear Reebok-branded uniforms and banned apparel and poster sponsors, so most fighters make less money and have less consistent income. Dana White's reasoning is that the sponsors were getting free airtime. Imagine NASCAR or PGA trying that.

If the NFL is really only interested in protecting highlights during game windows? Never, as that's not what ITP does. If the NFL decided to be draconian as MLB, we'd be out of business. NFL Game Pass, and Fair Use, make ITP possible. 

Not the same thing for .COM, which I'm sure would have more GIF and video content if they could, but MLB really would go after them. Like, I'm pretty sure that Rick guy knows a shitload about baseball he could convey if he could show at bats and highlights and stuff. 
 
MLB is out-asshole-ing the NFL on something. So congrats, I guess?

Portnoy was bragging about all the twitter stock he bought when it went public. His employees make fun of him for it constantly. He admitted a couple weeks ago that he lost over $150,000.

And they still refuse to verify him despite having nearly a quarter million followers on just his personal account...which is hysterical.

Understanding the need to enforce the copyright as much as possible, going after an independent guy making a mod for FO4 that lets you use an actual Sox jersey seems kind of pathetic.

Yes, yes, lawyers, I'm not going to argue with the legality and why this is done, etc. I'm saying it seems petty and counterproductive to building the brand.

Looks like the NHL is killing off all of the Twitter accounts who have created NHL GIFS. Two of the major accounts that have been deactivated/banned this week include Peteblackburn and myregularface.

Unless that was a ruse by the NHL so they didn't appear incompetent. Which I think is most likely true. (They never were/wanted going to hire her)

I gotta admit, Pete Blackburn might be my favorite follow on Twitter. His ongoing war with Haggerty (which is real and quite acrimonious...the GIFBOY moniker is not a term of endearment) is great and he's basically the kid brother whipping boy of all the B's hockey writers, but in a funny and self-deprecating way. Then after all this stuff with the .gifs and Twitter banning his account, he just tweeted these.

So if you listen to the "Listen to Brunch" podcast with DJ Bean and Blackburn, they talk about this. It was all a stunt/joke, but frankly a pretty successful one.

If you listen to the podcast though, you'll probably hate humanity and what social media has done to everyone.

Edit: And they trash Haggs which is always fun.
