It's a prior conviction, as opposed to a prior unproven accusation. So a lot depends on the timing of the charging documents. There are ways to do it, and there are circumstances where it would be precluded But usually, in practice, a S.A. would not seek that sort of enhancement for this type of crime on the basis that there were two incidents a day or two apart.

I don’t get why folks are so hung up on his spokesman’s Friday denial.
He hadn’t been formally charged at the time so why not blatantly deny it? What if he copped to it on Friday and somehow the states case blew up over the weekend?

Actually, I have gotten a variant to work. I was going to say no, but remembered a case from way back. It was a "confused young man" case though. I had a juvie client who was arrested for solicitation. The argument was that the kid really didn't intend to solicit the undercover officer and was just repeating stuff he didn't really understand. (And to be honest the kid was kind of slow.)

Thing is, a defense should never be evaluated outside of the facts of the case, the people involved, and the fact-finder(s). So did the above argument win because it was independently brilliant? Obviously not. It just happened to be a winning argument for that particular case with that particular defendant in front of that particular judge.

So, would the confused old man work for Kraft? With two videos? With the testimony of two witnesses? I'd have to see the vids and weigh the evidence entire, and know something about the prosecution team, but at this early stage, I'd certainly lean "no."

I'm going to look at it in terms of Robert Kraft and his reputation and his legacy. I think that this is how it is going to end. I think it will end with him giving the team to his son and never be in that suite again. I don't think that this is like Jimmy Irsay with drugs and a personal history of that problem. I don't think this is like Jerry Richardson with inappropriate behavior toward employees. Once you say sex trafficking, whether Robert Kraft knew this or not, I think that changes it.

Going with one of Epstein’s lawyers is probably smart but definitely gross.

And it read to me like he got a bj not an hj.

My brother's practice is around the corner, and they're in the PBC courthouse all the time. He texted me over the weekend that the SA is a HUGE Dolphins fan.
It's by far the nicest of Miami/Broward/PBC trio and sports an excellent law library. Although it's easier to get decent food and coffee close to the Miami courthouse.

FWIW, the SA also brought up diversion programs, etc. So I sort of doubt there's going to be a tough plea offer for Kraft. (I probably should have mentioned diversion programs as an option to resolve this as well.)

But who knows, maybe Kraft will test the motion waters first.

Maybe my calibration is off on this but I don’t see how this is remotely as bad as what Jerry Richardson was accused of. He was serially harassing team employees. The league has a much more vested interest in workplace behavior than what someone does outside of the team.

Kraft probably should have known better (on the trafficking angle, I have no issue with him paying for sex generally, it should be legal), and maybe it should be a bigger deal but then why is he only charged with a misdemeanor?

I don’t see Bob stepping aside and I can’t imagine the rest of the owners or the league stepping in and forcing him out over this. I think it is in the same neighborhood as Irsay and think the penalty will be similar.

I would guess that this wasn't the first time Bobby Kraft made a couple weekend visits to the Orchids of Asia.

Actually, to me it sounds like something they included in there because it makes the story sound worse. But while they were very explicit with the hand action, for some reason they decided to be vague about her head going “near”? There are several possible reasons for why that might have happened besides him receiving a BJ.

No one is "hung up" on it, we're just asking. We knew at that time there was video, so it seemed a hard denial was....interesting.

Sorry, shoulda been more clear. Didn’t mean to imply folks here, in this thread. I heard hosts and callers on the radio today talking about the denial, as if it’s some key piece and makes any material difference at all

Kind of? I mean, all of those hugs seem kinda weird unless he's asking for them as part of the package. Which would also be.... kind of weird.

There's also the fact that he just completely forgoes the perfunctory "massage" part of the rub n' tug and just lies face up on the massage table right off the bat. Pretty much every other client in the affidavit starts with a back massage and then flips over, right?

Then Kraft gives her a $100+ tip. Maybe meaningless considering Kraft is a billionaire. But fits the profile of a known, regular, and valued customer.

I'm making an inference and who really knows, but that's how it reads to me. Wouldn't be surprised if celebrity clients were what piqued the cops' attention in the first place. Which might also explain Schefter's tweet about a bigger name being on the list, then the cops shooting that rumor down. Could be plenty of bigger names that the cops know about but don't have concrete evidence on.
