I tweaked the thread title a bit — explaining the nature of the alleged bribe, and clarifying that Allen has not been charged with a crime (at least not yet). Sorry for the soxhopian length.

So, is the wealthy alum who promises to build a new library for the university, but only if his son or daughter is admitted, guilty of bribery? Are the officials at the university guilty of taking a bribe? Does it matter if they are "public officials" at a state university (e.g. Penn State) as opposed to officials at a private institution (e.g. UPenn)?
The whole thing is unseemly, but in terms of ethics/legal issues, I think there are a few important differences. Is it explicitly quid pro quo? Is the money/donation/bribe going into university property, or some individual's personal assets? Is the information disclosed to admissions? Is the information being used by admissions to evaluate the student true, or is the person receiving the bribe giving false information to get the student accepted in return for the bribe?
Yes, the distinction between a donation to the university itself vs a donation that enriches an individual who happens to work at the university is an important one. Of course an official in the development office who brings in a big donation also benefits individually in terms of career advancement, salary and bonus, etc.
